1. Challenge Football holds the right to update and/or change these terms and conditions at any time. All members of Challenge Football will be notified of any changes made. Challenge Football will assume agreement with continued membership.

2. Any member who would like to decline any changes to the terms and conditions is advised to follow the membership de-activation process.


Application

3. These terms and conditions will apply to any, and all, members of Challenge Football from the moment of registration and remain until any account is de-activated.

4. These are the terms at which membership is provided to you. You may only apply for membership if you are 13 years or older, unless you are able to provide consent from your legal parent/guardian if you are below the age of 13.


Interpretation

5. Member means an individual that registers with Challenge Football and acts with the purpose of their profile;

6. Contract means the legally binding agreement you and Challenge Football for the supply of services;

7. Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the website;

8. Services means the services advertised and offered on and through the website;

9. Website means our website, www.challengefootball.net, on which the services are advertised and offered;

10. Us refers to Challenge Football as a company.


Services

11. The description of services is as set out in the website and any other form of advertisement. Any description or advertisement is for description purposes only.

12. To ensure the services provided to you are as intended, it is your responsibility to ensure that all information and specification you provide is accurate.

13. All the services that appear on the website are subject to availability, information requirements and acceptance by Challenge Football.

16. We hold the right to suspend or withdraw the service we provide to any member without notice. We will not be liable for any reason when our services are unavailable.

17. We hold the right to add, change, suspend or delete any of our services without any notice.


Intellectual Property Rights

18. Challenge Football holds all Trademark rights for "Challenge Football" in Class 41 with Trademark Number: UK00003303594. Any use of the term must be agreed upon licence by Challenge Football.

19. Challenge Football owns and holds the rights to all material created, contributed and published on the site, in line with UK and worldwide copyright laws.

20. Challenge Football holds the right to suspend or deactivate any membership and destroy any material that is misuse of the material on the site or non-compliance with these terms.

21. You may share the material and information on the site to peers and associates to gain their attention to the services.

22. You may not use or modify any of the material for any commercial usage, unless previously agreed with Challenge Football.


Customer Responsibilities

23. You must co-operate with us in all matters relating to the services, provide us and our authorised employees and representatives with access to any premises under your control as required, provide us with all information required to perform the services and obtain any necessary licence and consents (unless otherwise agreed).

24. Failure to comply with the above is a Customer default which entitles us to suspend performance of the services until you remedy it or if you fail to remedy it following our request, we can terminate the contract with immediate effect on written notice to you.

25. It is your responsibility to keep security information, such as passwords, confidential. Do not pass this information on to a third party. If you pass any information on then you are liable for any consequences of third party use of the information.


Personal Information

26. We retain and use all information strictly under the privacy policy.

27. We may contact you by using e-mail or other electronic communication methods and you strictly agree to this.


Basis of Membership

28. The membership process is detailed on the website. You can amend membership details during active membership.

29. A contract will be formed for the services on offer only when you receive an email confirmation for the commencement of your membership. You must ensure that the details provided are correct and any inaccuracies are amended immediately.

30. Challenge Football is not responsible for any inaccuracies provided by a member of the website.

31. By registering you agree to us providing email confirmation of your membership and providing you with the advertised services.

32. A member can de-activate their account at any point by providing us with a notice of request to de-activate.

33. We reserve the right to suspend and/or terminate any membership at any time if we feel there is inappropriate usage.


Membership Profile

34. The information and media you provide will be used to form your profile for the service.

35. You accept all responsibility for the information you provide to make your profile and its visibility to other members of the website.

36. You must be aware of the information that is viewable on your profile to other members of the website.

37. Allowing someone to "follow" you on the site will make your profile information available for the "follower" to view.


Videos Footage, Uploads and Management

38. Videos will only be accepted by the website if uploaded from a YouTube link. Any uploaded video must follow the policies and procedures of YouTube.

39. The member is liable for any intellectual property infringement made in the process of uploading a video, whether related to the footage, personnel or any sound recording.

40. Challenge Football reserves the right to use any uploaded video for advertising or any other purposes.

41. Challenge football reserves the right to remove any video from the website without reason or notice.

42. Members may report a video if they believe it is fraudulent or inappropriate for the website. Reports can be made by e-mailing report@challengefootball.net.


Member Care

43. We will supply the service with reasonable skill and care.

44. Assistance and support will be available to the member throughout the duration of any membership held on the website. You can e-mail support@challengefootball.net.


Advertising

45. Any advertising or sponsorship that Challenge Football endorses will be strictly from the football, education or health industries and be considered as positive, supportive brands or products.

46. The use of advertising will only be used to enable Challenge Football to provide free and/or low cost opportunities for children to use the site, as well as allowing Challenge Football to maintain and develop the product financially.

47. To comply with the General Data Protection Regulation (GDPR (UK)) and Children’s Online Privacy Protection Act (COPPA (US)), no personal information that is registered to the site will be used in association with advertising in any way.

48. Any interaction that you have with a third party is, whether you have been linked through Challenge Football, will follow the policies, procedures and terms and conditions of the third party. Challenge Football holds no responsibility for any communications or transactions with third parties.


De-activation

49. This is a distance contract that may be de-activated upon request.

50. We hold the right to use any uploaded videos during the membership period for any advertisement purposes. You can apply to specifically request that a video you have uploaded is not used by Challenge Football by e-mailing your request to report@challengefootball.net.

51. We will adhere to de-activate an account within 24 hours of a request being made, but do not hold this as a guarantee. We will de-activate as soon as possible.

52. Once an account has been de-activated then all information prescribed by the member will be deleted from record.

53. The de-activation process is detailed on the website.

54. The contract is in place for the duration that we can offer the services, unless otherwise de-activated.


Privacy

55. We respect your privacy and comply with the General Data Protection Regulation regarding your personal information.

56. These terms and conditions should be read alongside, and are in addition to our policies, including our privacy policy and cookies policy (challengefootball.net/privacy-policy).

57. For the purposes of these Terms and Conditions:
a. Data Protection Laws means any applicable law relating to the processing of Personal Data, including, but not limited to the Directive 95/46/EC (Data Protection Directive) or the GDPR;
b. GDPR means the General Data Protection Regulation (EU) 2016 /679;
c. Data Controller, Personal Data and Processing shall have the same meaning as in the GDPR.

58. We are a Data Controller of the data we process in the service that we provide to you.

61. You, the member, are using Challenge Football and its services at your own risk. You are liable for any personal damage that may occur to you or any property that may occur during use of the services.

62. The member may be liable for:
a. any fraudulent act or omission;
b. death or personal injury caused during any participation of services;
c. any harmful act of any kind towards any other member or associate, including from distance (online);
d. any infringement of intellectual property such as trademarks, copyright or patents.

63. Challenge Football excludes liability for:
a. any fraudulent act or omission;
b. death or personal injury caused during any participation of services;
c. any harmful act of any kind towards any other member or associate, including from distance (online);
d. any infringement of intellectual property such as trademarks, copyright or patents.


Governing Law, Jurisdiction and Complaints

64. The contract (including any non-contractual matters) is governed by the law of England and Wales.

65. We would like to avoid any dispute, so we deal with complaints as follows:
Written complaint to support@challengefootball.net;
We will respond to all complaints as soon as possible and aim to do so within 48 hours.

66. Disputes can be submitted to the jurisdiction of the courts of England and Wales.
